                             ORDINANCE NO.   10149 
                  
                  
                   AN ORDINANCE ELIMINATING THE FIRST DIVISION
                   OF CITY COURT EFFECTIVE AT NOON APRIL 17,
                   1995, THE EXPIRATION OF THE TERM OF THE
                   PRESENT JUDGE OF SAID COURT.
                  
                  
                                                    
                  
                  
       	    	 WHEREAS, Public Chapter 712 of the Public Acts of
       Tennessee of 1994, codified as T.C.A. A7 16-17-101(b), 
authorizes
       home rule municipalities to eliminate divisions of city court at
       the expiration of the term of a judge; and
       	    	 WHEREAS, the term of the City Judge of Division One of
       the City Court of the City of Chattanooga expires at noon on 
April
       17, 1995; and
       	    	 WHEREAS, it is the consensus of the City Council of the
       City of Chattanooga that the case load of the City Court no 
longer
       justifies two separate divisions, so that one division should be
       terminated;
                                NOW, THEREFORE,
       	    	 SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
       CITY OF CHATTANOOGA, TENNESSEE, That Division One of the City
       Court of the City of Chattanooga shall be eliminated, operative 
as
       of noon, April 17, 1995.
       	    	 SECTION 2.  BE IT FURTHER ORDAINED, That this ordinance
       shall be effective two (2) weeks from and after its adoption as
       opposed to its operative date.
